Terms of Service

1. Acceptance

By creating an account or using the service, you agree to these Terms of Service ("Terms"). Read them carefully. If you do not agree, do not use the service.

2. Definitions

• Service: the website collectorstashmarket.com, the related mobile app, and all subdomains.
• Account: a registered profile with login credentials.
• Listing: a marketplace advertisement for a physical card.
• Bid: a price offer on a listing that allows bidding.
• Content: anything a user uploads — text, photos, bids, messages.

3. Account and age

• You must be at least 13 years old. Between 13 and 16, you need parent or guardian consent.
• You keep your credentials confidential and are responsible for activity on your account.
• You provide accurate, up-to-date information.
• One person may operate one account. Multi-accounts to bypass restrictions are prohibited.

4. Our role as a platform

CollectorsStashMarket is a neutral intermediary ("hosting provider" under the eCommerce Directive and the EU Digital Services Act). We are not a party to sales contracts between buyers and sellers. We do not pre-screen listings and provide no guarantee of quality, authenticity, or availability of cards offered.

5. Your content

• You retain copyright in the content you post.
• You grant us a worldwide, royalty-free, non-exclusive licence to display, distribute, and adapt your content as needed to operate the service (e.g., showing listings, resizing photos).
• You warrant that you own the rights to the content you post and that it does not infringe third-party rights.
• We may remove content that violates these Terms, our Acceptable Use Policy, or applicable law.

6. Marketplace rules

For sellers

• Describe the card accurately: game, set, name, condition, variant, grading if any.
• Use your own photos when the condition deviates from standard. Stock photos are not allowed for non-standard cards.
• Clearly indicate whether you sell as a private individual or as a trader (business). Traders are subject to additional consumer rights — see Refunds & Withdrawal.
• You are responsible for taxes, customs, and shipping.
• No counterfeit, proxy, or fraudulent cards. When in doubt, do not list.

For buyers

• A bid is a serious offer. If accepted, you are committed to purchase.
• Payment and delivery happen directly between buyer and seller. We provide no escrow or payment service.
• If in doubt about a card, ask before bidding.

7. Prohibited conduct

You may not:

• List counterfeit, illegal, or stolen items.
• Threaten, harass, or discriminate against other users.
• Send spam, phishing, or deceptive messages.
• Scrape, abuse, or reverse-engineer the service outside the official developer API.
• Bypass our security, rate limits, or moderation systems.
• Post sexually explicit, hateful, or violence-glorifying content.

8. Reporting and moderation

Use the Report button in the app or website, or email abuse@collectorstashmarket.com. We review every report and may remove content or suspend accounts. You may appeal a moderation decision by replying to the email in which the decision was communicated.

9. Intellectual property

• The service, including logo, brand, and software, is owned by CollectorsStashMarket.
• Card names, illustrations, and game mechanics are owned by the respective publishers (Wizards of the Coast, The Pokémon Company, Konami, Bandai, Disney, and others). We claim no rights to that material and are not affiliated with those publishers. See Disclaimer.

10. Warranties and liability

The service is provided "as is". We do our best but offer no guarantees on price-data accuracy, service availability, or successful completion of user-to-user transactions. To the extent permitted by law, our liability is limited to direct damages caused by our gross negligence, capped at €100 or the amount you paid through the service in the past year, whichever is higher. Liability for intent or wilful recklessness remains uncapped.

11. Termination

You may delete your account at any time via /account-deletion. We may suspend or terminate accounts for severe or repeated violations of these Terms.

12. Governing law

These Terms are governed by Dutch law. Disputes are submitted to the competent courts in the Netherlands, unless mandatory consumer law provides otherwise.

13. Changes

We may amend these Terms. The effective date appears at the top of this page. For material changes we notify you by email or in-app. Continued use after a change constitutes acceptance.
